Hello Ms. Hernandez Mats,
My name is Bill Detzner. Readers wanting further information about what I discuss in this letter can find that 2 October 2018
information in my blog mdcpsallegations.com I am asking you to share this letter with all members of the UTD Hello Ms. Hernandez Mats.
Executive Council, Superintendent Carvalho, and all 9 members of the school board. (I am once again asking that school board members ask Mr. Carvalho to immediately remove the 2 present NKC administrators and replace them with former principal Dr. Alberto Fernandez and former assistant principal Henny Cristobol. If Mr. Carvalho fails to do this in a timely manner, I am asking school board members to contact Governor Rick Scott and ask the governor to remove Mr. Carvalho for non-performance of his duties.) I have sent many unanswered certified letters to several MDCPS stakeholders. I have sent 6 of these letters to you (Ms. Hernandez Mats), 6 to Mr. Carvalho, 4 to Mr. Feldman, 3 to Mr. Gallon, 3 to the Florida Commissioner of Education, 3 to Dr. Shirley Johnson,(the President of the Miami NAACP), 2 to Governor Rick Scott (plus a third letter that was not sent via certified mail), 1 to Senator Bill Nelson, 1 to Betsy DeVos, and 1 letter to every member of the MDCPS school board. With the exception of Betsy DeVos, none of my certified letters have resulted in a response. Not. A. Single. Word. in response to 38 certified letters over a 3- year period. I have 2 reasons for sending you this 7’th certified letter. First, I don’t want you to bleat that you did not know what is going on in Neva King Cooper (NKC) School. Secondly, I want to show readers of my blog that MDCPS is a criminal enterprise, and that Superintendent Carvalho seems to have the ability to unilaterally make decisions in violation of both Federal and state law. The two stakeholders who are supposed to serve as a check on Mr. Carvalho, (UTD and the school board) either cannot or will not hold Mr. Carvalho to either uphold the law, or to protect the lives of Profoundly Mentally Handicapped (PMH) children. My belief is that MDCPS is an “old boys/old girls” organization that has become so corrupt that reform can ONLY come from the Governor, either Rick Scott, or his successor. Although this letter is addressed to you (Ms. Hernandez Mats), my hope is that the letter will be read by other people who are aware of my blog. These people include Governor Rick Scott, Senator Bill Nelson, Dr. Shirley Johnson, Pulitzer Prize winner Leonard Pitts, Cameron Kasky, Bill Gates, and the education reporters for both the Miami Herald and the New York Times. If Governor Scott fails to step in to stop the egregious criminal actions of MDCPS, my hope is that Senator Bill Nelson will see fit to make a t.v. commercial showing that Governor Scott has been aware that PMH children have been exposed to an entirely preventable danger of choking to death on their food and done NOTHING to protect those children. Mr. Kasky is the co-founder of the Marching for Our Lives, the organization protesting inadequate safety precautions in public schools that have led to entirely preventable student deaths. Mr. Kasky has a special needs brother. Mr. Kasky has stated that he would be extremely upset if his special needs brother suffered harm while at school. I am hoping that Mr. Kasky and the students Of Marjory Stoneman Douglas High School will see that a superintendent and school board that exposes PMH children to an entirely preventable risk of choking to death on their food [seemingly to terminate teachers who were foolish enough to exercise their supposedly protected choice to convert to a charter school] are just as guilty of terrorism as a disgruntled student with a gun (For that matter, I hope both Governor Scott and Senator Nelson also share this view.) I am hoping that Dr. Shirley Johnson will read the September4, 2018 letter that is posted on my blog and come to the conclusion that both NKC principal Dr. Tracy Roos and assistant principal Alicia Fernandez give the appearance of being racists who have committed numerous egregious violations against the dignity and civil rights of the African American employees of NKC.
I am asking that Ms. Hernandez Mats take the following three actions: 1) Ask the National Labor Relations Board to do a county wide audit of MDCPS to determine if Federal labor laws are being enforced. 2) Send a written memorandum to Mr. Carvalho asking that both NKC principal Dr. Tracy Roos and assistant principal Alicia Fernandez (Screamer) be immediately relieved of their duties as NKC administrators and be replaced by Dr. Alberto Fernandez as the new principal and Mr. Henny Cristobol as the new assistant principal. 3) I am asking UTD to file a grievance for a violation of the civil rights of the African American employees of NKC. Last spring, in an effort to prop up the abysmally low scores that the 2 NKC administrators generate year after year on the MANDATORY staff satisfaction surveys, the para-professionals of NKC were ILLEGALLY prevented from taking this MANDATORY survey. As many NKC students are in wheelchairs and need to be lifted out of those wheelchairs to have their diapers changed, there are almost as many paraprofessionals as teachers at that school. A high percentage of those paraprofessionals are African Americans. By ILLEGALLY preventing paraprofessional from taking this MANDATORY survey, it meant that only a small percentage of African Americans took the survey, while a very high percentage of African American staff were discriminated against, and not allowed to participate in this MANDATORY survey. Mr. Carvalho, yourself (Ms. Hernandez Mats), and the entire school board is aware of this blatant discrimination against African Americans because I sent each of you a certified letter describing this violation. Um, Ms. Hernandez Mats, I don’t know if you are aware of this, but a significant portion of the UTD membership is composed of African Americans. Judging by the fact that you have done NOTHING to address this problem, my assumption is that you are OK with the fact that MDCPS discriminates against African Americans!. As there is a 6- month window of opportunity to file these charges, UTD NEEDS TO TAKE THIS ACTION AS QUICKLY AS POSSIBLE Ms. Hernandez Mats, if you allow this matter to lapse, my hope is that the UTD Executive Council will remove you from office for non-performance of your duties. The contact person is Michelle Reid (404) 974-9386. Or Arthur Manigault at (404) 974-9376. The UTD steward at NKC is Mr. Brett Darwin Brown. As NKC appears to be one of many “no go” zones for UTD for the last 6 years, the UTD officials may have no clue who Mr. Brown is, or what he looks like. In the unlikely event that the well paid UTD officials are able to screw up their courage and enforce their contractual right to visit the NKC campus, Mr. Brett Darwin Brown is an African American man about 55 years of age. In the event that MDCPS elects to illegally punish Mr. Brown for engaging in protected union activities, and UTD pretends not to see the district illegally retaliating against Mr. Brown, I want to state for the record that Mr. Brown HAD NOTHING WHATSOEVER TO DO with my (Mr. Detzner) actions to involve the Atlanta Ga. office in an action against MDCPS. As UTD is an extremely timid organization, and as MDCPS is an extremely vindictive organization, I have deliberately had no contact whatsoever with many NKC people, including Mr. Brown. So, if MDCPS or Dr. Roos or Mrs. Fernandez (Screamer) is contemplating retaliation against Mr. Brown, please be aware of the fact that the only contact I have had with Mr. Brown in the last 3 years was when I telephoned him like a bolt out of the blue a few weeks ago to let him know I had contacted the NAACP and that that organization might be contacting Mr. Brown.
Ms. Hernandez Mats, it distresses me enormously that THREE YEARS of writing 38 certified letters have not resulted in even a miniscule decrease in the flagrantly illegal actions of either one of the NKC administrators. For example, a few weeks ago, a very gifted NKC teacher who has joined the long, long line of employees who have left NKC due to the excesses of BOTH NKC administrators made the mistake of attempting to visit his/her colleagues at NKC. This teacher visited the NKC campus between 2:00 P.M and 3:00 P.M. At that time, ALL STUDENTS HAD GONE HOME FOR THE DAY, AND THE ENTIRE STAFF HAD THEIR PLANNING PERIOD. This teacher, (who is a very pleasant and easy- going person who gets along very well with all NKC staff) signed the visitors log and began cordial conversations with NKC staff. Dr. Roos “allegedly” (I will use the word allegedly to protect myself legally) ordered the security person to tell this teacher to either leave the premises immediately and never return, or the school police would be summoned and this teacher, who is still a MDCPS teacher at a different school would be arrested. This teacher is a resident of Miami-Dade County, and a taxpayer. As such, having signed in, he/she had a legal right to be at that school. Does Dr. Roos intend to use that same “technique” to run every other Miami-Dade County taxpayer visitor off the NKC campus? If not, why was this teacher treated differently than other taxpayers? Given the fact that no students were on campus, no staff objected to the presence of this person on campus, and the person signed in at the office as a visitor, did Dr. Roos have the authority to run this teacher off campus? Is NKC the property of Dr. Roos or is it the property of the taxpayers of Miami- Dade County.? Given the fact that there were no students on campus, and given the fact that it was the teachers planning period, and given the fact that this teacher had signed in at the office, and given the fact that this teacher is extremely popular with the NKC staff, what was Dr. Roos reason for running this teacher off campus? It is difficult to believe that Dr. Roos (who seems to derive great satisfaction out of bullying and humiliating her staff) was unaware of how humiliating and unpleasant this experience must have been for this outstanding and well- liked teacher.
Ms. Hernandez Mats, you do not give the appearance of being the sharpest tool in the shed. Having said that, I am sure that even you are able to understand that the reason MDCPS administrators feel safe in committing numerous egregious contract violations is because in the 3 years you have been the UTD president, UTD has UTTERLY failed to enforce the contract or impose penalties on administrators who violate the contract. (Perhaps this is because you were busy spending UTD funds to throw a celebratory party when Mr. Carvalho declined his job offer in New York City). It is my deepest hope that you either not run for another term of office, or the UTD Executive Council removes you for non-performance of your duties. The teacher that Dr. Roos illegally ran off the NKC campus poses a potential problem for the allegedly criminal behavior of assistant principal Alicia Fernandez (Screamer). In my blog, I described in great detail how Mrs. Alicia Fernandez (Screamer) filed charges against Mr. Rick Massa. (As Mr. Massa is now retired, and out of the reach of the extremely vindictive MDCPS goons and thugs (I mean bureaucrats) he is one of the few people who cannot be retaliated against, so I will use his name.) Mrs. Fernandez (Screamer) filed charges against Mr. Massa for Mr. Massa’s alleged cheating on the Florida Alternate Assessment (FAA). The FAA is the high stakes yearly achievement test that is given to Profoundly Mentally Handicapped children. In an effort to save money, only a few copies of the test are given to our school, so teachers share the testing materials. A teacher will test his/her class, and then hand the testing materials to the next teacher. When Mr. Massa received the testing materials, they had been used by a rookie (i.e. inexperienced) teacher who had marked the correct answers in the test booklet, and then gave that test booklet to Mr. Massa. Mr. Massa, who was well aware that he was public enemy number one in the eyes of both NKC administrators, went to Mrs. Fernandez (Screamer) office, and showed Mrs. Fernandez (Screamer) the marked test materials. THERE WAS A TEACHER PRESENT IN MRS. FERNANDEZ (SCREAMER) OFFICE WHO WITNESSED THIS EXCHANGE BETWEEN MRS. FERNANDEZ (SCREAMER) AND MR. MASSA. The teacher who witnessed this exchange was the same teacher that Dr. Roos recently illegally ran off the NKC campus. Mrs. Fernandez (Screamer) thanked Mr. Massa for this information about the marked test booklet, allowed Mr. Massa to exit her office and begin testing his students, waited 10-15 minutes, used her master key to enter Mr. Massa’s classroom, and was SHOCKED, SHOCKED to discover that Mr. Massa was “CHEATING” on the high -stakes achievement test! Later, under oath, Mrs. Fernandez (Screamer) allegedly committed perjury when she made a deposition in Mr. Massa’s resulting lawsuit for Mrs. Fernandez (Screamer) trumped up charges. Mr. Massa then went to the teacher who observed the exchange between Mr. Massa and Mrs. Fernandez and asked if he/she would be willing to testify on behalf of Mr. Massa. This teacher, who will never have tenure, and can be fired at the drop of a hat, replied that he/she had a family to feed, and feared (correctly) he/she would be fired if he/she testified. Well, this teacher is no longer at NKC. Normally, this teacher could be kept quiet, because Mr. Carvalho gives the appearance of being an absolute dictator. Everyone I know, from administrators to paraprofessionals DEEPLY fears Mr. Carvalho. Under normal circumstances, if this teacher were to threaten to tell the truth, Mr. Carvalho has the option of quietly whispering to the administrator in charge of this teacher to threaten the teacher with termination if he/she obeyed Mr. Carvalho’s often repeated commandment of “If you see something, say something.” An administrator who fails to carry out any of Mr. Carvalho’s wishes risks termination, or an end of the administrator’s career advancement. Mr. Carvalho has a BIG problem here. You see the new administrator of this teacher is a man/woman that Mr. Carvalho illegally attempted to terminate. The case went to an administrative hearing, and it was found that Mr. Carvalho and MDCPS had broken every rule in the book to attempt to illegally fire this person. Having this black mark against him, Mr. Carvalho must be very careful not to again attempt to illegally remove this administrator. The administrator cares very deeply about the quality of education delivered to students. He/She has no qualms about removing a non- performing teacher. However, as the teacher who was chased out of NKC is an outstanding teacher, he/she is not in danger of losing his/her job while an employee of this administrator. This is a teacher that the National Labor Relations Board (NLRB) needs to speak to AFTER they guarantee he/she will not be retaliated against for his/her testimony. Ms. Hernandez Mats, I have been asking you for YEARS to contact the NLRB, and you have not done so. Why is this? Given the fact that you are not willing to take this step, my hope is that either Governor Scott or his successor will take this step. Also, since Dr. Roos and Mrs. Fernandez (Screamer) have been the NKC administrators, NKC students have achieved results on the yearly high stakes achievement test (FAA) that seem to be vastly in excess of their intellectual capacities. (The NKC administrators achieve a hefty cash bonus for these astonishing results) As the test results under the previous administrators (principal DR. Alberto Fernandez and assistant principal Mr. Henny Cristobol) were MUCH lower for a period of several years, it is possible that cheating on this test has occurred. These tests are kept on file for several years. If the NLRB or any other investigative body investigates this, I know the names of 2 people who are no longer at NKC who may be able to shed quite a bit of light on this.
In my blog, I talked about how Mrs. Green, an African American grandmother was allegedly threatened with an involuntary transfer to another school, shortly after the brutal murder of Mrs. Green’s daughter. I also said that an African American custodian, Mr. Aaron Jackson was allegedly threatened with termination by Dr. Roos. Dr. Roos gives the appearance of being an extremely vindictive person. If Dr. Roos does what she has done in the past, during the 2018-2019 school year, Dr. Roos may receive one of her famous “anonymous” phone calls, accusing one or both of these African Americans of physically and/or sexually molesting one or more profoundly mentally handicapped children. As these children cannot speak, this charge will be extremely difficult to disprove. If this happens, my guess is that neither Superintendent Carvalho or Ms. Hernandez Mats will lift a finger to protect these 2 African American employees.
Last year, during school hours, on campus, a very talented, hardworking teacher with over 30 years of experience who is a former winner of the Teacher of the Year award allegedly suffered what appeared to be a nervous breakdown. When I was teaching at NKC, literally every day, I worried that either Dr. Roos or Mrs. Fernandez (Screamer) would charge me with totally fabricated career ending charges. I am guessing that is what caused that teachers alleged meltdown. Dr. Roos gives the appearance of deriving enormous pleasure out of creating misery for her staff. She also never seems to miss an opportunity to humiliate her staff. On the last day of school, Dr. Roos allegedly called a MANDATORY faculty meeting. At that meeting every teacher EXCEPT the teacher who had the alleged nervous breakdown was awarded a prize. Ms. Hernandez Mats, BOTH the teacher who suffered the alleged nervous breakdown and the teacher that Dr. Roos illegally ran off campus are UTD members. Does that bother you? Is your attitude that the only thing UTD members are entitled to for their $800 yearly dues is a lousy desk calendar? A few years ago, a former NKC employee (who is still employed at another MDCPS school) was allegedly physically assaulted by Dr. Roos. Does that bother you? Does the fact that this person did not feel safe enough to report the incident to MDCPS officials bother you? This person would be a GREAT person to talk to the NLRB or another investigative body, don’t you agree? Ms. Hernandez Mats, does it bother you that Federal laws that prevent employers from physically assaulting their employees are not being observed in “The People’s Republic” of MDCPS? Would you agree that a body that receives Federal funds also ought to obey Federal laws? Or is everything OK with you, just as long as you continue to be paid your six- figure salary?
During the 2011-2012 school year, NKC attempted to exercise its right under Florida law to convert from a public school to a charter school. In legal case DOAH 13-1492, it was shown that Mr. Carvalho and MDCPS illegally smashed this conversion process. For the last 6 years, now continuing into the 7’th year, Mr. Carvalho has been breaking Florida law by punishing NKC and keeping it under a virtual lockdown. If an investigative body examines MDCPS, I suspect they will find Mr. Carvalho has more skeletons in his closet than there are in a cemetery. I suspect this is the reason Mr. Carvalho was turned down for the number two spot in the Obama Administration’s Department of Education.
The biggest beef that I have with Mr. Carvalho and MDCPS is their seeming willingness to play Russian Roulette with the lives of Profoundly Mentally Retarded children by exposing them to an entirely preventable death from choking to death on their food. As I have covered this topic extensively in nearly every blog entry for over 3 years, I will refer readers to my blog.
I want to end this letter by again stating that “The People’s Republic” of MDCPS is so hopelessly corrupt and owned by Mr. Carvalho that reform from within is impossible. If reform comes to MDCPS, an outside agency will have to come in and clean house, from top to bottom. While this letter is addressed to the UTD president, my REAL targeted audience is Governor Rick Scott (or his successor) Senator Bill Nelson, Mr. Cameron Kasby, Dr. Shirley Johnson Mr. Leonard Pitts, and the newspaper reporters from the New York Times and the Miami Herald
Mr. Carvalho, I am a very patient and persistent man. My goal is to reach a tipping point, where the pain of keeping Dr. Roos and Mrs. Fernandez (Screamer) exceeds the pain of replacing them. Mr. Carvalho, a wise person once said that Pride goeth before a Fall. If you wait too long on taking some long overdue actions, an outside authority may decide that MDCPS is better off without you. May that day come quickly.
